Bail Amount Estimator

Estimates a suggested bail amount based on offense type, criminal history, flight risk factors, and community ties. This is an educational estimate only — actual bail is set by a judge.

Formula

Step 1 – Base Bail: Determined by offense severity schedule (Infraction $500 → Capital Felony $1,000,000).

Step 2 – Risk Multiplier:
  riskMultiplier = priorsFactor × ftaFactor × dangerFactor

Step 3 – Community Ties Multiplier:
  tiesMultiplier = employmentFactor × residenceFactor × familyFactor

Step 4 – Adjusted Bail:
  adjustedBail = baseBail × riskMultiplier × tiesMultiplier × jurisdictionFactor

Step 5 – Income Proportionality:
  incomeAdj = clamp(0.75 + 0.5 × ln(income/56000 + 0.5), 0.6, 1.5)
  finalBail = adjustedBail × incomeAdj

Step 6 – Rounding: Rounded to nearest $500.

Step 7 – Bounds: Clamped between 25% and 2000% of base offense amount.

Bail Bond Premium: bondPremium = finalBail × 10% to 15%

Assumptions & References

  • Base bail amounts follow typical U.S. bail schedule ranges used in California, Texas, New York, and federal courts.
  • Risk multipliers are derived from the Public Safety Assessment (PSA) tool developed by Arnold Ventures, which weights prior convictions, FTA history, and current offense severity.
  • Community ties factors (employment, residence, family) are standard considerations under 18 U.S.C. § 3142 (Bail Reform Act of 1984).
  • Income proportionality uses a logarithmic scale anchored to the U.S. median household income (~$56,000, U.S. Census Bureau 2023).
  • Jurisdiction multipliers reflect cost-of-living and local bail schedule differences across rural, suburban, urban, and high-cost metro areas.
  • Bail bond premium of 10–15% reflects standard non-refundable surety bond fees charged by licensed bail bondsmen in most U.S. states.
  • This tool is for educational purposes only. Actual bail is set at the discretion of a judge or magistrate and may differ significantly. Some jurisdictions (e.g., New Jersey, Washington D.C.) have largely eliminated cash bail.
